These Terms of Hire (“Terms”) form the agreement between Pacific Detectors Limited (“we”, “us”, “our”) and the person or organisation hiring our equipment (“you”, “the Hirer”). By booking and paying for a hire, you confirm that you have read, understood, and agree to be bound by these Terms.
1. The Equipment
The “Equipment” means the Event Security Screening Kit, including:
• 1 × Garrett Multi Zone walk-through metal detector
• 2 × Garrett Super Scanner V handheld metal detectors
• 1 × Protective wheeled transport case
• All associated cables, bolts, fittings, and accessories supplied with the kit
The total retail replacement value of the Equipment is NZ$23,000 (GST inclusive). This figure is referenced throughout these Terms.
2. Hire Period
2.1 The hire period begins on the agreed start date and ends on the agreed end date as confirmed in your booking.
2.2 We strongly recommend including an additional day before your event for setup and practice, and an additional day after for pack-down. Your hire period must include all days the Equipment is in your possession.
2.3 The Equipment must be returned (or made available for collection) by the agreed end time on the final day of hire.
3. Payment Terms
3.1 Hire Fee: 100% of the hire fee, plus delivery (where applicable), is payable on booking by bank transfer. Your booking is not confirmed until payment is received in full.
3.2 Security Bond: A refundable security bond of NZ$2,000 is payable by bank transfer no later than 7 days before the agreed delivery or collection date. We reserve the right to cancel a confirmed booking and retain the hire fee in accordance with our cancellation policy if the bond is not received by this deadline.
3.3 Bond Return: The security bond will be refunded by bank transfer within 5 business days of the Equipment being returned to us and inspected. We may deduct from the bond any amounts owing under these Terms (including damage, cleaning, late return fees, or replacement costs).
3.4 GST: All hire fees are quoted exclusive of GST unless stated otherwise. The security bond is GST-exclusive (no GST applies to refundable bonds).
4. Cancellation Policy
If you cancel a confirmed booking:
• 14 or more days before hire start date: full refund less a $200 administration fee
• Between 7 and 14 days before hire start date: 50% refund
• Within 6 days of hire start date: no refund
We will always try to accommodate a rescheduled date rather than a cancellation where possible, subject to availability. Rescheduling requests should be made as early as possible.
5. Delivery, Collection & Return
5.1 Delivery and collection arrangements will be confirmed at the time of booking. Delivery costs are quoted separately based on your location.
5.2 You are responsible for being available to receive the Equipment at the agreed time, and for making the Equipment available for return collection at the agreed time.
5.3 If you are unavailable at the agreed time, additional fees may apply for re-delivery, re-collection, or storage.
5.4 The Equipment must be returned in the same condition as it was supplied, clean, dry, and properly packed in the supplied transport case.
5.5 Transport delays. Where Equipment is shipped by courier or third-party transport company, we will arrange dispatch with adequate time for expected delivery. However, we are not liable for delays, damage, or losses caused by couriers or transport companies, or by events outside our reasonable control (including but not limited to weather, traffic, mechanical failure, industrial action, or carrier service failures). We strongly recommend allowing extra hire days before your event to mitigate any transport-related delays – see Section 2.2.
6. Late Returns
6.1 If the Equipment is not returned by the agreed end time on the final day of hire, you will be charged:
• The full daily hire rate ($495 + GST per day) for each day or part-day of late return
• A late return administration fee of $100 per day
6.2 These charges may be deducted from your security bond. If they exceed the bond, the balance is payable on invoice within 7 days.
6.3 If the Equipment is more than 7 days overdue without prior arrangement, we reserve the right to treat it as lost and invoice the full replacement value (see Section 9).
7. Your Responsibilities
You agree that during the hire period you will:
7.1 Use the Equipment only for its intended purpose (event security screening) and in accordance with the supplied instructions and setup video.
7.2 Ensure the Equipment is operated by responsible adults who have viewed the setup video or received training from us.
7.3 Provide a safe, dry, undercover location for the Equipment with adequate standard mains power.
7.4 Keep the Equipment secure at all times, including overnight, and not leave it unattended in publicly accessible areas.
7.5 Not modify, repair, dismantle (beyond standard hand assembly/disassembly), or attempt to service the Equipment.
7.6 Not sub-hire, lend, or transfer the Equipment to any third party.
7.7 Not use the Equipment outside New Zealand.
7.8 Notify us immediately of any damage, malfunction, theft, or loss.
7.9 Return the Equipment in the same condition as supplied, clean, dry, and correctly packed in the transport case.
8. Our Responsibilities
We will:
8.1 Supply the Equipment in good working order, pre-programmed for your event.
8.2 Provide setup instructions, a step-by-step setup video, and direct phone support throughout your hire period.
8.3 Use reasonable efforts to repair or replace faulty Equipment during your hire period, subject to availability and time constraints.
8.4 Refund or credit the proportional hire fee where Equipment failure (not caused by you) prevents normal use, in accordance with Section 11.
9. Damage, Loss & Theft
9.1 You are responsible for the Equipment from the moment it is delivered to you (or collected by you) until the moment it is returned to us (or collected by us).
9.2 Minor damage: Repairable damage will be charged at actual repair cost, deducted from the security bond. If repair costs exceed the bond, the balance is payable on invoice.
9.3 Major damage or total loss: If the Equipment is lost, stolen, or damaged beyond economic repair, you are liable for the full retail replacement value of NZ$23,000 (GST inclusive). The security bond will be applied to this amount, and the balance is payable on invoice within 14 days.
9.4 This liability applies regardless of fault, including theft, vandalism, fire, water damage, or accidental damage. The Equipment is your responsibility while in your possession.
10. Insurance
10.1 You must either:
• (a) Hold valid insurance that covers the Equipment for its full replacement value of NZ$23,000 (GST inclusive) against loss, theft, and damage during the hire period; OR
• (b) Accept personal or organisational liability for the full replacement value as set out in Section 9.
10.2 By accepting these Terms, you confirm that one of the above applies. We may request evidence of insurance for larger or higher-risk hires.
10.3 We strongly recommend that you also hold appropriate public liability insurance for your event. Some venues and events require this regardless of equipment hire.
11. Equipment Operation & Limitation of Liability
11.1 We do not provide security services. Pacific Detectors Limited supplies hire equipment only. Under our standard hire and Setup + Go services, we provide the Equipment, setup instructions, and phone support – nothing more. Under our Fully Managed service, we may additionally provide operational training and on-site staff support, but we do not at any time provide security services, security personnel, threat assessment, or screening decisions. The decision to admit, refuse entry to, search, or further screen any individual is entirely the responsibility of you and your operators or security personnel.
11.2 No guarantee of detection. Metal detection equipment has inherent limitations. We do not warrant or guarantee that the Equipment will detect every metallic object or threat. Effective screening depends on correct operation, sensitivity settings, operator vigilance, and screening procedures, all of which are the responsibility of the Hirer and their operators.
11.3 Limitation of liability. To the maximum extent permitted by law:
• (a) Our total liability under these Terms is limited to the hire fee paid by you for the affected hire.
• (b) We are not liable for any indirect, consequential, or special losses, including but not limited to: lost profits, lost revenue, event cancellation costs, reputational damage, third-party claims, injury or property damage at your event, or losses arising from undetected items, regardless of cause.
• (c) Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 where it applies. If you are acquiring the Equipment for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 do not apply.
12. Equipment Failure During Hire
12.1 If the Equipment fails during your hire period through no fault of yours, contact us immediately on the support number provided.
12.2 We will use reasonable efforts to talk you through troubleshooting, arrange a replacement, or arrange a repair, depending on the nature of the failure and the time available.
12.3 If we cannot restore Equipment functionality during your event, our liability is limited to a refund of the hire fee for the affected period in accordance with Section 11.3(a).
13. Force Majeure
Neither party is liable for failure to perform under these Terms due to events beyond reasonable control, including natural disasters, severe weather, government action, pandemic-related restrictions, or carrier and transport service failures. In such cases, we will work with you in good faith to reschedule the hire or provide a fair refund.
14. Privacy
We collect and hold personal information about you in accordance with the Privacy Act 2020. We use this information to manage your booking, deliver Equipment, communicate with you, and meet our legal obligations. We do not share your information with third parties except as required to provide the service or comply with the law.
15. General
15.1 Governing law. These Terms are governed by New Zealand law. The parties submit to the exclusive jurisdiction of the New Zealand courts.
15.2 Entire agreement. These Terms, together with your booking confirmation, form the entire agreement between us. They supersede any prior discussions or representations.
15.3 Variation. We may update these Terms from time to time. The Terms in force at the time of your booking apply to your hire.
15.4 Severability. If any part of these Terms is found to be invalid or unenforceable, the remaining Terms continue to apply.
15.5 Assignment. You may not transfer your rights or obligations under these Terms without our written consent.
Acknowledgement
By making payment for a hire, you confirm that:
• You have read and accept these Terms of Hire
• You are 18 years or older and authorised to enter into this agreement
• You either hold appropriate insurance for the Equipment, or accept personal/organisational liability for its full replacement value
• The information you have provided in your booking is accurate
